Rights and Usage

For real estate photography, it's important to keep the cost down, and rights have been assigned for the duration of the current listing period of the home at the time it is photographed. This short-term usage of the images facilitates charging the least amount of money.

 The use and duration of the images is used to determine the price. The longer the duration of rights assigned, the more the photos generally cost.

To serve your marketing needs most affordably and efficiently, I have set forth the following industry standard real estate photography licensing of my images. To be clear, the images are not sold to you; they are licensed.  This allows me to lower my price dramatically for the time spent shooting and editing compared to other types of photography:

Creatively You Marketing (CYM) owns the copyright to all images (US Copyright Act, Title 17, US Code). All right, titles, and interests, in and to the photographic materials, including without limitation the copyrights, design patents, publicity, attribution (and other rights in the photographic materials), including without limitation any renewals or extensions thereof, now and hereafter arising, shall be and shall remain except as may be subsequently licensed by CYM the sole property of CYM in perpetuity, throughout the world. Permissions granted to Client are expressly conditioned upon payment in full; absent full payment, such permissions shall be deemed void ab initio. The client is not authorized to remove copyright management information from CYM work. Any authorization granted to the Client to use CYM work is conditioned on the Client's inclusion of the copyright management information, which in no event shall include less than CYM's authorship designation and copyright notice, and such other information as would permit through a reasonably diligent search the identification of as the copyright owner. Permissions granted may not be assigned or sub-licensed.

The client is purchasing a license to use images for advertising and marketing one property during the CURRENT SALE LISTING at the time of being photographed. Images may not be used to market another, similar property, nor may they be provided to any third party including, but not limited to, stagers, homeowners, builders, other agents, or any print or Internet publication without the consent of the photographer. Images used as cover shots for magazines and/or marketing publications must also include credit to the photographer.
